Paul Greenberg, Arbitrator

Arbitrator Paul Greenberg served as Chair/Chief Judge of the U.S. Department of Labor’s Administrative Review Board from 1998 to 2002. He began his private arbitration practice soon after leaving the Board. He is a member of the National Academy of Arbitrators.

Mr. Greenberg’s practice includes dispute resolution work in several fields, including commercial claims, securities matters, labor and employment cases, and construction industry disputes. He serves on numerous arbitrator rosters and panels.

Although arbitration procedures are much less formal than court proceedings, Mr. Greenberg brings his experience and training as a judge to the arbitration process. Whether conducting a trial or an arbitration hearing, the core challenges of an adjudicator are the same: to make sure the parties have a fair opportunity to present their case, and then determine the relevant facts and apply the applicable rules (statutes, contracts, labor agreements, etc.) that govern the dispute.

Although the formal rules of evidence used in court ordinarily do not apply in arbitration proceedings, the principles and goals motivating the rules of evidence come into play: to the maximum extent possible, the arbitrator’s decision should be based on information (evidence) that is reliable and solid. Thus while hearsay evidence often is introduced in arbitration proceedings, Mr. Greenberg makes sure all evidence is tested and evaluated carefully during the decision making process.
