Although arbitration procedures are much less formal than court proceedings, Mr. Greenberg brings his experience and training as a judge to the arbitration process. Whether conducting a trial or an arbitration hearing, the core challenges of an adjudicator are the same: to make sure the parties have a fair opportunity to present their case, and then determine the relevant facts and apply the applicable rules (statutes, contracts, labor agreements, etc.) that govern the dispute. Although the formal rules of evidence used in court ordinarily do not apply in arbitration proceedings, the principles and goals motivating the rules of evidence come into play: to the maximum extent possible, the arbitrator’s decision should be based on information (evidence) that is reliable and solid. Thus while hearsay evidence often is introduced in arbitration proceedings, Mr. Greenberg makes sure all evidence is tested and evaluated carefully during the decision making process. Representative decisions, speeches, and publications are available. Mr. Greenberg's resume also is available. In addition to arbitration services, Mr. Greenberg serves as a mediator; serves as a fact-finder or hearing officer; conducts internal investigations; and serves as a neutral evaluator for disputes. In addition to disputes referred through organizations that administer arbitrator rosters, Mr. Greenberg also may be contacted directly by parties interested in retaining his services as an arbitrator.
