As a mediator, Paul Greenberg helps parties in conflict explore opportunities for voluntary settlement of legal disputes, thereby avoiding the time, expense and stress that come with litigating lawsuits through the trial and appeal process.

Parties embroiled in litigation often become entrenched in their views, convinced their position is correct and the opposing side is wrong, or worse. The desire to “win” – and the corollary goal of seeing the other side “lose” – can lock parties into positions that do not advance their true interest: finding a way to resolve the dispute quickly and fairly.

Through the mediation process, Mr. Greenberg works with clients to create a productive atmosphere in which they have the confidence to focus on creative and practical problem solving. The parties have an opportunity to engage their opponent; to assess and analyze the strength and weakness of each side’s respective position; and to evaluate the various risks associated with the dispute and consider carefully whether continued litigation advances their interests. Through mediation, parties become empowered to resolve disputes themselves, rather than placing their fate in the hands of a judge or jury.

Depending on the nature of the claims and the desires of the parties, Mr. Greenberg uses both facilitative and evaluative techniques to help parties in conflict reach solutions that advance their interests. The mediation process results in improved outcomes, including early resolution of disputes and reduced risk exposure.

A former Chair and Chief Administrative Appeals Judge of the U.S. Department of Labor’s Administrative Review Board (ARB), Mr. Greenberg’s mediation experience includes successful resolution of whistleblower claims under arising under environmental statutes and the Sarbanes-Oxley Act; discrimination complaints against private companies and government agencies; personal injury claims; breach of contract; construction disputes; and community association disputes.
 
In addition to his mediation services and his work as an arbitrator, Mr. Greenberg conducts internal investigations, provides neutral evaluations, and serves as a fact-finder for government agencies and private organizations.
